This course will introduce the history legal maxims, how they are formed, their relationship to other disciplines of Islamic studies, and the contributions of Muslim jurists on the subject.
This course will introduce the history legal maxims, how they are formed, their relationship to other disciplines of Islamic studies, and the contributions of Muslim jurists on the subject.
The five major legal maxims and their subsidiary maxims and regulations will be covered in detail. Each maxim will be explained, its sources discussed, and how the maxim was formulated covered as well. Finally, variance of juristic opinion on the use of particular maxim(s) will be highlighted.
Course Objectives
1. To impart a general understanding of Islamic Legal Maxims;
2. To familiarize the student with the interconnectivity of Islamic disciplines.
3. To study major maxims and their applications; and
4. To equip the students with a set of Islamic legal principles.
On successful completion of this course, students should be able to:
1. Understand various maxims and the methodology used to formulate them;
2. Identify the contribution of Muslim jurists on the subject;
3. Apply those maxims to relevant issues in other areas of study.
